The untimely death of a loved one can cause extreme trauma to a family. Not only will they have to adjust to life without the love and guidance of the deceased, they will also be facing medical and end-of-life expenses. One New York family recently received the shocking news about the death of a loved one in a fatal motorcycle accident.

The accident reportedly occurred on a recent Friday afternoon in Oneida. The accident report of the Oneida Police stated that a 57-year-old motorcycle rider was eastbound on Lennox Avenue. As he approached Stone Street, a 38-year-old driver in a sedan halted at the intersection and allegedly proceeded to turn left without yielding for the approaching motorcycle.

The driver of the sedan claims that a stationary vehicle obscured approaching traffic from her view. The rider was thrown from the motorcycle when he smashed into the car. He was rushed to the hospital but sadly succumbed to his injuries there. The other driver received medical treatment for facial lacerations at the accident scene. She is now facing charges related to failure to yield upon turning left.

The grieving New York family of the deceased driver may choose to pursue recovery of damages. A wrongful death claim in a civil court will require proof of negligence on the part of the other driver, but it may result in a monetary judgment to ease their financial burden. Such a judgment may cover hospital expenses, along with the costs of a funeral and burial, but it will not in any way replace the cherished loved one. However, it may allow the family to move forward after the fatal motorcycle accident.
