How can an attorney help following a truck accident?

New York sees its fair share of trucking accidents every year. Victims often suffer severe injuries, and some of them even lose their lives. Following a truck accident, it may be possible for victims or -- in the event of a fatality -- their surviving family members to seek compensation for their losses. How they go about seeking relief may affect how much they get in the end.

Following any type of auto accident, insurance providers will try to settle with victims before a case is taken to court. They do this because it saves them money. They do not do this to benefit the victim or his or her family. In fact, those who settle with insurance providers without legal assistance often receive far less than they should.

An attorney can help victims or their family members seek maximum relief for their losses. How? For starters, one's legal counsel will have the ability to investigate every aspect of the case, including looking into the various parties who may be held accountable. Legal claims can then be filed against the right people.

One's legal counsel can try to negotiate a fair settlement out of court. They can do this by calculating current and projected losses based on the damages reported. This can remove a lot of stress from client.

If out-of-court negotiations fail, one's attorney can file and litigate the appropriate claims in a New York civil court. To do this successfully, it will be necessary to establish that the parties responsible for the truck accident were negligent in their actions. While not always an easy feat, if it works in the client's favor, maximum damages may be awarded.
