Driver responsible for fatal pedestrian accident charged

An elderly man is facing charges in New York following an accident that left one person dead and several others injured. This fatal pedestrian accident occurred Nov. 26, at Forsyth and Canal Street. A total of five pedestrians were involved in this incident.

According to reports, at approximately 6:47 p.m., a man in his 70s was attempting to parallel park when he lost control of the vehicle and hit people on the sidewalk. One man, said to be in his 40s or 50s, died at the scene of the accident. Four other people were taken to an area hospital. Two are said to have suffered critical injuries, and the other two are said to have suffered serious injuries.

The driver and a passenger in his vehicle both suffered minor injuries and refused treatment. Authorities say that the elderly gentleman has been cooperating with police. Charges were filed late in the evening of Nov 26. The driver has been charged with failure to exercise care and failure to yield. It is unclear if the responsible party is still in police custody or if a court date regarding this matter has been scheduled.

Accidents happen, but many can be avoided if drivers exercise the proper care. As negligence is believed to have contributed to this fatal pedestrian accident, the surviving victims and the family members of the deceased may all pursue civil claims in a New York court against the party deemed responsible in an effort to seek compensation for their losses.
