Mother and son hit while crossing in a crosswalk

Police in New York are in the process of investigating yet another pedestrian accident. This particular event occurred the morning of Feb. 27, in Brooklyn. A mother was walking her son to school when they were hit while crossing the street in a crosswalk.

According to reports, at approximately 8:15 a.m., a 7-year-old boy, accompanied by his mom -- age 39 -- attempted to cross the street at the intersection of Blake and Pennsylvania Avenue. As soon as they entered the crosswalk, a jeep plowed into them while making a right-hand turn. The boy suffered critical injuries and was transported to an area hospital where he was pronounced dead. His mother was also hurt in the wreck. She was treated and released from the hospital the same day.

Authorities say that the driver responsible for this event -- a 48-year-old female -- did not have the right of way when she attempted her turn. She did stay at the scene and is said to be cooperating with the police. Investigators say this individual was driving with a suspended license. She was charged with failure to yield and operating a vehicle without a license -- among other things. It is unclear if any additional charges are expected in this case.

As the mother and son had the right of way and were hit while crossing a crosswalk, driver negligence is believed a factor in this case. This means that the mother may take legal action against the driver in an effort to seek compensation for her injuries and for the loss of her son. To do this, she will need to file personal injury and wrongful death claims in a New York civil court. With the assistance of counsel, she may achieve maximum relief for her losses through out-of-court negotiations or, if necessary, litigation.
