84-year-old woman killed in pedestrian accident

Police in New York are investigating an accident that left an elderly woman dead. It is unclear if the driver responsible for this pedestrian accident will face any criminal charges. If they desire, the victim’s surviving family members may be entitled to pursue legal actions in civil court in an effort to seek compensation for their losses.

According to reports, the 84-year-old victim was crossing East 79th Street and had one foot on the curb when the driver of an SUV attempted a left-hand turn, mounted the curb and struck the woman. She suffered critical injuries to her head and body. Emergency response declared her deceased at the scene after being unable to revive her.

The driver claims that her SUV has brake problems. She remained at the scene and is said to be cooperating with authorities on this matter. As of the latest report, no arrests have been made.

Right now there are a lot of unanswered questions in this case. At the end of the day, whether the victim’s family may pursue relief for their unexpected losses all comes down to negligence — does it exist in this case? If negligence can be established and the driver deemed fully responsible for this pedestrian accident, compensation may be achieved through out-of-court negotiations or litigation in a New York civil court. The victim’s loved ones may turn to legal counsel in order to learn what options are open to them and pursue the legal course that will help them seek to achieve maximum relief.
